1.1 |
The reference to "member" or "membership" in these rules shall mean "associate member" or "associate membership" respectively. |
|

|
|
| |
1.2 |
An ordinary, ordinary (general) or associate member below the age of 65 years who has fully paid up his subscriptions for not less than twelve (12) consecutive months shall be eligible to participate in the AUPE Mutual Aid Welfare Scheme I (hereinafter referred to as Scheme I). |
|
|
|
| |
|
|
| |
1.3 |
Subject to the provisions of Regulations 1.1, 1.2 to Schedule I above and Table A to Schedule I below and any other limitation contained in these Regulations, the benefits payable under Scheme I shall be based on years of continuous membership with the Union as from 1.8.1973. |
|

|
| |
|
|
| |
1.4 |
To determine the length of membership only the last period of not less than twelve (12) months during which the member has continuously and regularly paid his subscriptions shall be taken into account. |
|
|
|
| |
|
|
| |
1.5 |
An associate member who ceases to be a member of the Union for any reason shall be considered a new associate member when he rejoins and all benefits due to him under Scheme I shall be calculated as from the date of his rejoining. |
|
|
|
| |
|
|
| |
1.6 |
An ordinary member or an ordinary (general) member, as the case may be, who ceases to be a member of the Union for any reason but who rejoins immediately as an associate member without any break in membership shall have all benefits due to him under Scheme I calculated as from the date he became an ordinary member or an ordinary (general) member. |
|

|
| |

| |
1.7 |
An associate member who ceases to be a member of the Union for any reason but who rejoins immediately as an ordinary member or ordinary (general) member without any break in membership shall be eligible for any benefits under Scheme I as an ordinary member or ordinary (general) member, as the case may be. |
|

|
| |
|
|
| |
1.8 |
Notwithstanding Regulation 1.2 to Schedule I above, no associate member shall be entitled to any benefits if: |
|
|
|
| |
|
|
| |
|
(a) |
he is in arrears of subscription; |
|
|
|
| |
|
|
| |
|
(b) |
an injury is sustained or death occurs while he is under the influence of alcohol, drugs or any other intoxicant (unless such drugs be administered by or in accordance with a physician's prescription); |
|
|
|
| |
|
|
| |
|
(c) |
an injury is sustained or death occurs whilst he is insane whether the nature of the insanity be permanent or temporary; and |
|
|
|
| |
|
|
| |
|
(d) |
an injury is sustained or death occurs through suicide or attempted suicide, intentional self-injury, intemperance, addiction to drugs, deliberate exposure to needless danger (except in an attempt to save human life), war, invasion or attack of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, riot, civil commotion, revolutions, insurrection, coups or any other form of military or civil disorder. |

2.1 |
The claim in respect of any injury or death shall be given in writing to the Committee within 21 days of the occurrence of such event. |
|

2.2 |
In default of such notice as stated in Regulation 2.1 above, the Union shall be under no obligation to make payments under Scheme I in respect of such injuries or provided that where the Committee in its discretion decides the delay in the notification was reasonable in the circumstances, it may make payments in respect of such injuries or deaths. |
|

2.3 |
Notwithstanding the provisions of Regulation 2.2 above, where the notice of claim is filed after a lapse of 90 days from the date of injury no payment shall be made under Scheme I. |

3.1 |
All evidence required by the Committee, including documentary evidence in support of the claim shall be furnished by the Claimant at his own expense. |

4.1 |
In the event of a member's death the beneficiary shall be the member's nominee registered in the Nominee Register provided that where such nominee is a minor at the time of payment of the benefits due, the benefits shall be paid in trust to his legal guardian or to the Public Trustee. |

4.2 |
In the event a member has not nominated a beneficiary, and regardless whether the member dies intestate or not, Section 7 of the Intestate Succesion Act on rules of distribution shall apply in the case of a non-Muslim member, and Section 112 of the Administration Law Act on distribution of Muslim estates to be according to Muslim estates shall apply in the case of Muslim member. |

5.1 |
Where there is more than one claimant and the Committee is unable to resolve the matter, the disputed claim or claims shall be referred to the General Purposes Committee whose decision shall be final. |

5.2 |
When the General Purposes Committee is itself unable to come to a decision, it may refer the matter to the Executive Council or Public Trustee for advice. |

5.3 |
Notwithstanding Regulations 5.1 and 5.2 above, where a claim has already been registered any subsequent claim made 30 days after the member's death shall be invalidated. |

6.1 |
Where there is no registered nominee, settlement of any claim upon the death of the member shall not be before 30 calendar days. |

6.2 |
In the case of a claim by a registered nominee upon the death of the member, settlement shall be within thirty calendar days of the receipt of notice of such claim. |
|

6.3 |
All benefits computed under this Scheme upon the death of a member shall be paid in one lump sum to the Claimant. |
|
|
|
| |
|
|
| |
6.4 |
Notwithstanding any other provision in these regulations, the Committee shall be entitled to withhold payment until such time as it is satisfied with the bona fides of the claim. |
|

|
| |
|
|
| |
6.5 |
In the event of any dispute, settlement shall be withheld until the dispute is resolved by the General Purposes Committee whose decision shall be final. |

(A) |
Total permanent loss of the use of a member shall be treated as loss of such member. |

(B) |
In the event of partial loss of any limb or organ above referred or of partial paralysis or insanity, a proportionately lower percentage of benefit shall be payable. |
|
| |
|
|
| |
|
(C) |
In the event of permanent disablement by physical loss or loss of use of any part of the body the percentage of benefit payable shall be assessed in proportion to the degree of disability in comparison with the injuries specified above without any reference to the occupation of the injured member. |
|
| |
|
|
| |
|
(D) |
Where the injury is not a physical loss, satisfactory medical proof shall be submitted by the Claimant that the disablement will in all probability continue for the rest of the injured member's life. |
|
| |
|
|
| |
|
(E) |
The items 5 to 11 above refer to injuries arising out of accidents only. |
|
| |
|
|
| |
|
(F) |
The expression 100% means a sum between $1000 to $2700 in accordance with Table B to Schedule 1. |
